I work regular hours and receive 20% extra per hour in my wages. Am I a casual employee?

You may in fact be a part-time employee because whilst casual employees usually receive the 20% loading many part-time employees (those working less than 20 hours per week) also receive the 20% loading. You can tell which one you are by looking at the Award definition of a casual:

A casual employee' means a person who either:

  • relieves a full-time or part-time employee;or
  • is engaged temporarily for specific duties for a period not exceeding eight weeks (taken from the Nursing Homes Award, Disability Service Providers Award & Hospitals Award)
If you are engaged to provide relief while a full-time or part-time employee is absent (for eg; maternity leave, workers compensation, leave without pay etc.) then this arrangement should be confirmed in writing by your employer. If you do work set hours regularly (for longer than eight weeks) and you are not relieving in another employee's position, you may be able to claim these hours permanently
