I am pregnant. What are my maternity leave entitlements?

Employees are entitled to up to 52 weeks unpaid maternity (or paternity) leave when they have a baby, as long as they have completed at least 12 months continuous service with their employer.

If both parents wish to take some unpaid leave the 52 weeks is shared between them (ie. you cannot take 52 weeks each) and often cannot be taken simultaneously.

Public sector employees are entitled to 12 weeks paid maternity leave. This paid leave forms part of the 52 week maternity leave period (ie. 12 weeks paid and up to 40 weeks unpaid leave).

Some private sector employees also have access to some paid maternity leave through their enterprise bargaining agreements.

Once your maternity leave has finished you are entitled to return to the position you held before taking leave.
