When am I entitled to Long Service Leave?
Public sector employees are entitled to long service leave after ten years of continuous service.
Private sector employees are entitled to long service leave after fifteen years of continuous service. However, some private sector enterprise bargaining agreements allow employees to take long service leave after ten years continuous service.
Long Service leave entitlements do not transfer from one employer to another so the accrual commences again each time you move from one employer to another, unless a transfer agreement has been negotiated.
A pro-rata entitlement to long service leave may occur in both the public and private sectors after seven years if an employee ceases work because of ill health, redundancy, retirement, dismissal (other than for serious misconduct) or in the event of a pressing personal necessity.
Members who believe that they may have a claim to pro-rata entitlement should seek advice from HACSU prior to resignation.
