Long Service Leave ChangesThe Long Service Leave (State Employees) Act 1994 has undergone some Legislative changes that allow for anyone over the age of 65 to now accrue an entitlement to Long Service Leave. Previously the Act only allowed employees to accrue an entitlement to Long Service Leave up to the age of 65. Other minor anomalies that have been identified are also to be amended. The Amendment Bill rectifies this to provide for the intended application of the Act. The Amendment states "State employees aged more than 65 years will be able to accrue long service leave entitlements, consistent with being able to work on past age 65 in accordance with the State Service Act 2000. This amendment is retrospective from the date of proclamation of the State service act so that current employees affected by the change are not disadvantaged." The amending Act can be viewed on www.thelaw.tas.gov.au Long Service Leave (State Employees) Amendment No 5 of 2003. The Bill has been through both Houses of the Tasmanian Parliament and is now awaiting "royal assent".
