Question of the week


“I’m thinking of leaving my job. I’ve worked for the same employer for 8 years, and some of my friends have told me I should be eligible for pro rata Long Service Leave. Is that right?


The answer to the question depends on the reason for leaving the position.

Broadly speaking, pro rata entitlements are available after 7 years' service if a member ceases work because of;

  • retirement,
  • redundancy,
  • dismissal (for any reason other than serious and willful misconduct)
  • Ill health (of such a nature to justify the termination of employment), or
  • domestic or other pressing necessity (of such a nature to justify the termination of employment).

The employer may require written evidence in support of such a claim.
