Representation for Workers Compensation Matters

As part of your HACSU membership, our lawyers offer representation in the Workers Compensation Tribunal at a heavily discounted rate if you are unfortunate enough to be injured at work and make a Workers Compensation claim.

This representation will cost a maximum of $95 (plus GST)up to the time the Tribunal determines whether you have a claim against your employer (known as a Section 81 Hearing). If your claim is accepted then you will receive Workers Compensation Payments. In the event that a member is unsuccessful in obtaining compensation or/and wishes to pursue the matter further then the cost of further representation is a matter to be negotiated between the member and the lawyer. In this event the $95 fee for the Section 81 hearing is waivered.

Subject to the agreement with Ogilvie Jennings, there is provision for a "no win no fee" service. This means that if you continue with a claim based on favourable advice from Ogilvie Jennings and lose you will not be charged for any professional time. If you win, costs will charged based on the Supreme Court Scale plus 50%. Up to two thirds of the costs based on the Supreme Court Scale can be recovered from the other side.

Members can seek initial advice from the lawyers in workers compensation matters before deciding to use Ogilvie Jennings. If a member decides after the first visit not to proceed then there is no charge.

Other Legal Matters

Apart from Workers Compensation, members often need legal advice on a range of personal legal matters. These may include family law matters, commercial, estates, criminal law and purchasing property.

As part of the arrangement negotiated with Ogilvie Jennings, the first visit with the lawyer is free to HACSU members. This first free visit is not just the time spent with the lawyer but also any necessary letter or short follow-up required as a result of the visit

HACSU members can also take advantage of free wills, conveyancing at two thirds the normal cost and family law matters receive a 15% discount.

Referral to the Lawyers

Members need to contact the HACSU office and ask for a written referral. The referral is evidence that the person is a member of HACSU and includes the telephone number of Ogilvie Jennings. The member should then telephone Ogilvie Jennings themselves to arrange an appointment. The location of appointments will be in Hobart, Launceston, Devonport or Burnie. Members should take their written referral to the first appointment with the lawyer.
